These terms are the agreement between you and Lex White for the website, the live show, the chat, and the gig guide. By using any of them, you agree to these terms. If you do not agree, do not use them.
Lex White operates lexwhite.net and live.lexwhite.net from Kauaʻi, Hawaiʻi. That includes the pages, music files, photos, the Kauaʻi gig guide, the live video when a show is on, the web chat, and any relay of that chat to or from a Discord channel. Features can change, pause, or stop without notice.
There is no account to create. A name you type into the chat is a nickname for that visit, not an identity Lex White verifies.
You may use the services for personal listening, watching, chatting, and for finding public booking information. You will not:
Lex White may remove a message, end a chat session, or block a stream or address that breaks these rules, without notice.
The chat is public. What you type may be shown on the live page, on the IRC channel, and, when the bridge is on, in one Discord channel. Do not put secrets, private contact details, or anything you do not want relayed in the chat.
You keep ownership of your messages. You grant Lex White a non-exclusive license to display, store, and relay those messages as part of running the chat, including through the Discord bridge, for as long as the logs are kept. Logs may be deleted at any time.
Unless a page says otherwise, the site, the text, the photos, the recordings of shows, and the arrangement of the gig guide belong to Lex White. Music files are offered under the license named on the track or the page, often Creative Commons Attribution-NonCommercial. That license does not give you the right to use the music in advertising or in other commercial work.
Do not copy the site design, remove credit, or present Lex White’s work as your own. Names, logos, and the look of the site may not be used to imply a partnership that does not exist.
A show is live only while someone is publishing to the stream. Off air, the player may show videos from Lex White’s YouTube channel, which are covered by YouTube’s own terms. A connection can fail. Picture and sound quality are not guaranteed.
Shows may be recorded on the server for a limited time so the operator can keep a copy. Those recordings are not a public archive, and they may be deleted. Do not rely on a recording being available later.
The gig guide is a list of rooms, markets, and boards gathered for the musical community of Kauaʻi. It is information, not an offer of work, not a booking, and not a promise that a venue is hiring, open, or paying any particular amount. Venues change. You are responsible for confirming details with the venue before you rely on them. Marks you make in the tracker stay in your own browser.
Links to YouTube, Discord, Bandcamp, SoundCloud, Venmo, PayPal, Cash App, and other sites leave lexwhite.net. Those services have their own terms. Donations and purchases are handled by them, not by this site. Lex White does not control their fees, refunds, or outages.
The services are provided “as is” and “as available.” To the fullest extent allowed by law, Lex White disclaims every warranty, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. There is no warranty that the site, stream, chat, music, or gig guide will be accurate, uninterrupted, secure, or free of errors.
To the fullest extent allowed by law, Lex White will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost gigs, lost data, or lost goodwill, arising out of your use of the services or your inability to use them. Lex White’s total liability for any claim related to the services will not exceed the amount you paid Lex White for the service that gave rise to the claim in the three months before the claim. If you paid nothing, the limit is zero. Some places do not allow these limits. In those places, the limits apply as far as the law allows.
You will indemnify Lex White against claims, damages, and reasonable expenses, including attorney fees, that come from your messages, your use of the services, or your breaking these terms. Lex White may choose counsel for a claim you have to cover.
You may stop using the services at any time. Lex White may stop offering any part of them, or stop serving you, at any time. Sections that by their nature should survive, including ownership, disclaimers, liability limits, and indemnity, stay in effect.
These terms can be updated by posting a new version at this address. The effective date at the top will change. Continuing to use the services after that date means you accept the new terms.
Hawaiʻi law governs these terms, excluding its conflict-of-law rules. Courts located in the State of Hawaiʻi are the exclusive venue for disputes, and you consent to personal jurisdiction there. If a court holds one part of these terms unenforceable, the rest stays in effect.
